Agreement to Terms
Welcome to WealthTrac. These Terms of Service ("Terms") govern your access to and use of the WealthTrac mobile application, website, and related services (collectively, the "Service"), operated by WealthTrac ("we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Eligibility
To use WealthTrac, you must:
- Be at least 18 years of age
- Be a resident of the United States
- Have the legal capacity to enter into these Terms
- Not be prohibited from using the Service under applicable law
For advisors: You must hold valid financial advisory credentials and be in good standing with relevant regulatory bodies. We reserve the right to verify your credentials and reject applications at our discretion.
Not Financial Advice
Important: WealthTrac is a technology platform that facilitates connections between clients and financial advisors. We do not provide financial advice, investment recommendations, or tax advice. Any information provided through the Service is for informational purposes only.
Financial advisors on our platform are independent professionals. We do not endorse, recommend, or guarantee the services of any advisor. You are responsible for evaluating and selecting advisors based on your own due diligence.
User Accounts
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.
Financial Data Connections
WealthTrac uses third-party services (SnapTrade and Quiltt) to connect to your financial accounts. By connecting accounts, you:
- Grant us read-only access to account balances, holdings, and transaction data
- Acknowledge that we cannot initiate transactions, transfers, or account changes
- Understand that connection availability depends on third-party services
- Accept that we are not responsible for inaccuracies in data provided by financial institutions
You may disconnect your financial accounts at any time through the app settings.
Data Sharing and Consent
For Clients: Your financial data is shared with advisors only when you explicitly grant permission. You control what data is shared and can revoke access at any time through the app.
For Advisors: Your profile information is visible to potential clients on our platform. Client data shared with you is subject to professional confidentiality obligations and applicable regulations.
Subscriptions and Billing
WealthTrac offers subscription plans for advisors:
- Free Trial: New advisors receive a 14-day free trial with full access to features.
- Billing: Subscriptions are billed monthly or annually through your app store (Apple App Store or Google Play Store).
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds: All sales are final. We do not provide refunds for partial months.
Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Impersonate another person or misrepresent your identity
- Harass, abuse, or harm other users
- Share false or misleading information
- Attempt to access accounts or data that does not belong to you
- Reverse engineer or attempt to extract our source code
- Use automated systems to access the Service without authorization
- Interfere with the proper functioning of the Service
Intellectual Property
The Service and its original content, features, and functionality are owned by WealthTrac and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.
Limitation of Liability
To the fullest extent permitted by law, WealthTrac shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
We are not responsible for:
- Investment decisions made based on information from advisors
- Losses resulting from financial transactions
- Disputes between clients and advisors
- Service interruptions or data loss
- Third-party services or content
Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
You may delete your account at any time through the app settings. Data retention after account deletion is governed by our Privacy Policy.
Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through the app at least 30 days before the changes take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved in the courts located in Delaware.
